The Firm processes your personal data in accordance with Chilean Law No. 19.628 on the Protection of Private Life. This policy explains what data we process, for what purpose, and how you can exercise your rights.

    1. Who we are

The data controller is Estrada y Asociados SpA, Tax ID (RUT) 77.589.788-0, with registered address at Cerro El Plomo 5931, Office 1213, Las Condes, Santiago, Chile. For any inquiry or to exercise your rights, write to us at contacto@estradayasociados.cl.

    2. What data we process and from whom

Given the nature of our services (recognition of European citizenships and nationalities by descent, such as Italian citizenship and Spanish nationality; consular procedures; and visa consultation), we process data from:

    • Clients: those who engage our services.
    • People who contact us or complete our form before becoming clients, to assess the feasibility of their case.
    • Ancestors and other members of the client's family line, whose data is necessary to prove the line of descent.

The data we process includes: name, identity document, date and place of birth, nationality, address, email, and phone number; ancestry-line information (births, marriages, and deaths, family relationships) contained in certificates and records; in visa consultations, the documentation the visa requires depending on its type (for example, regarding studies, employment, or financial means); and technical data the website collects when you visit it (IP address, browser, cookies).

Some of this data comes directly from you, and some from public records (Civil Registry certificates and equivalents).

    3. What we use your data for

We use your data solely for the purposes for which it was collected (Article 9 of Law No. 19.628), specifically to:

    • Assess the feasibility of your case and prepare a proposal.
    • Manage and process your case: recognition of citizenship or nationality, consular procedures, or preparation of your visa documentation, as applicable.
    • Comply with our legal and contractual obligations to you.
    • Communicate with you regarding the service.

We do not use your data for purposes other than those disclosed without your authorization.

    4. On what basis we process your data

The processing of your data is based on your authorization, given in writing and informed as to its purpose, under Article 4 of Law No. 19.628; or when the law authorizes the processing.

You may revoke your authorization at any time, in writing and without stating a reason. Revocation does not affect the lawfulness of processing carried out prior to it.

    5. Sensitive data

To prove your line of descent, we need death records and certificates of your ancestors. From these documents we require the fact of death, its date and place, and the family relationships they record. In some cases, the official document also contains the cause of death, which the law considers sensitive data. The Firm collects these documents because they are essential to the purpose of the service and limits their processing to that purpose: it does not use any health information they may contain for its own purposes, nor does it disclose it beyond what is necessary to process your request, in accordance with Article 10 of Law No. 19.628.

In visa consultations, some visas also require medical certificates or criminal record certificates. Medical certificates contain data about health status, which the law also considers sensitive data. The Firm requests these documents only when the visa that applies to your case requires them and processes them solely to prepare your application: it does not use them for its own purposes, nor does it disclose them beyond what is necessary to file the application with the relevant authority. Criminal record certificates receive the same protection.

    6. Who we share your data with

We do not sell or trade your personal data. To provide the service, we may rely on technology providers (email and cloud storage, client management, scheduling, electronic signature, among others) who process data on our behalf and under a duty of confidentiality, under the mandate regulated by Article 8 of Law No. 19.628.

Those who work at the Firm are bound to secrecy regarding data not obtained from public sources (Art. 7), an obligation that continues even after their relationship with the Firm ends.

We may also disclose your data when required by law or by a decision of the competent authority.

    7. Retention and care of your data

We retain your data for as long as the service relationship lasts and for as long as necessary to fulfill legal obligations and any resulting liabilities. We keep your data accurate and up to date, and safeguard it with due diligence (Articles 9 and 11).

    8. Your rights

Law No. 19.628 grants you the following rights over your data (Article 12), free of charge and non-waivable by contract (Article 13):

    • Information and access: to know what data of yours we process, its origin, the purpose of its storage, and to whom it is regularly disclosed.
    • Modification: that we correct erroneous, inaccurate, misleading, or incomplete data.
    • Deletion: that we delete your data when its storage lacks legal grounds or has expired, or when you provided it voluntarily and no longer wish it to be kept.
    • Blocking: that we temporarily suspend the processing of your data in cases permitted by law.

    9. How to exercise your rights

To exercise any of these rights, write to us at contacto@estradayasociados.cl. We will respond within two business days. If we do not respond within that period or deny your request without legitimate cause, you may go to the civil court of the Firm's domicile to request protection of your rights, under Article 16 of Law No. 19.628.

    10. Commercial communications

If at any time we use your data to send you commercial communications or advertising, you may object to that use and request to be removed from the relevant registry, at any time and free of charge (Articles 3 and 12).

    11. Changes to this policy

We may update this policy to reflect legal or operational changes. We will always indicate the date of the current version. We recommend reviewing it periodically.

This privacy policy is in effect until November 30, 2026. Starting December 1, 2026, a new privacy policy will apply in accordance with new Law No. 21.719, which regulates the protection and processing of personal data and establishes Chile's Data Protection Agency.
